Does independent living need a license in Florida?

No: independent living apartments and 55+ communities that provide no personal care need no AHCA license, while a life plan community needs an OIR certificate of authority for its continuing care contracts and AHCA licenses for any assisted living or nursing units.

When an independent living resident needs help, care comes from a licensed home health agency, a move to assisted living, or a campus's own licensed units.

What is a 55+ community?

A 55+ community is housing that qualifies for the federal Housing for Older Persons Act exemption, generally with at least 80 percent of occupied units having a resident 55 or older; it is a housing rule, not a care service.

Many 55+ communities in Lakewood Ranch, North Port, Venice and Parrish are owner-occupied homes with clubhouse amenities.

How does a life plan community differ from independent living?

A life plan community adds a contract that guarantees access to higher levels of care, usually for an entrance fee, under Chapter 651; plain independent living rentals make no promise about future care.

When does independent living stop being enough?

When help with bathing, dressing, medications or safety is needed every day, a resident needs either regular home care or a move to assisted living, which in a life plan community may mean moving across the campus.

Check what the contract or lease says about that transition before moving in.

Can someone in independent living use home health?

Yes; a resident of independent living or a 55+ community can receive Medicare home health, hospice and privately paid home care exactly as in any private home.

That is often how couples manage when one spouse needs some help.

Are 55+ communities regulated for safety or care in Florida?

Not as care providers: a 55+ community is housing, governed by its homeowners association or landlord, building codes and fair housing law, and no state agency inspects it for care because it provides none.

If a 55+ community or independent living building begins providing personal care to residents, it needs an AHCA assisted living license. Unlicensed care can be reported to AHCA at 1-888-419-3456.

How many life plan communities are there in Sarasota and Manatee?

Florida OIR's October 2025 map lists 9 continuing care retirement communities in the two counties.
